Purpose
These Terms set out how the website www.eau-808.com may be accessed and used. The website is published by SEEM 808 — Société d’Exploitation de l’Eau Minérale 808, an Elior Group subsidiary, whose full contact details appear in our
legal notice.
They apply to every visitor to the website, wherever they access it from and whatever device they use.
Acceptance
Consulting the website constitutes full and unreserved acceptance of these Terms. If you do not agree to them, it is for you to refrain from using the website.
Use of the website’s forms further presupposes acceptance of our
privacy policy, which describes how the information you send us is handled.
Access to the website
The website is freely accessible, with no account creation and no prior identification. The connection and equipment costs required remain the responsibility of the visitor.
SEEM 808 employs reasonable means to provide continuous access to the website, without being bound by any obligation of result. Access may be suspended, restricted or interrupted at any time, in particular for maintenance, update or security operations, or by reason of an event beyond the publisher’s control. Such interruptions give rise to no entitlement to compensation.

Nature of the website
This website is a showcase website. It presents 808, its source, its collection and its references. It is not an online store.
No online sale is offered here: no cart, no firm order and no payment can be made from this website. No banking or card details are requested here, and we will never request any by email.
Enquiries are made solely through the forms provided, or by telephone and email. An enquiry sent through this channel amounts to neither an order, nor a reservation, nor a commitment by either party: it opens a discussion with our sales department.
Prices are quoted on request, according to the profile of the enquirer, the volumes, the format selected, the destination and the applicable Incoterm. No price is displayed on the website. A sale is formed only by an accepted quotation or a written order confirmation, governed by the general terms of sale provided on that occasion, which alone are binding in commercial matters.
Intellectual property
All the elements making up the website — architecture, visual identity, texts, photographs, videos, illustrations, logos, trademarks and databases — are protected under the French Intellectual Property Code and remain the exclusive property of SEEM 808 or of its rights holders.
Consulting the website confers a strictly private and non-exclusive right of use. Any reproduction, representation, adaptation, modification, distribution or commercial exploitation, in whole or in part, is prohibited without prior written authorization.

Accuracy of the information
The information published on this website is provided for guidance only. SEEM 808 takes the greatest care over its accuracy and its updating, without being able to warrant that it is at all times exhaustive or free from error.
Product characteristics — mineral composition, pH, dry residue, carbon dioxide content, formats, capacities, presentation of the bottles and gift sets — are liable to change. The composition of a natural artesian water is moreover subject to natural variation; the published values correspond to the reference analyses and do not constitute a contractual commitment.
The same applies to logistics data — quantities per pallet or per container, weights, minimum order quantity, lead times, Incoterms, customs codes and regulatory identifiers — which are provided by way of guidance and must be confirmed case by case when the quotation is drawn up.
Only the particulars borne on the product labeling, together with the contractual documents issued by the sales department, are authoritative.
Limitation of liability
SEEM 808 shall not be held liable for indirect damages resulting from use of the website, in particular loss of business, loss of data or commercial harm.
Nor shall its liability be incurred in the event of unavailability of the website, of an error or omission in the information published, of a malfunction of the visitor’s device or connection, or of interference with the visitor’s system by a third party.
The website may contain links to websites published by third parties, over which SEEM 808 exercises no control and for whose content it assumes no responsibility.
Nothing in these Terms shall exclude the liability of SEEM 808 in the event of gross negligence or willful misconduct, nor in any case where the law prohibits such exclusion.

SEEM 808 reserves the right to amend these Terms at any time, in order to adapt them to developments in the website or in the applicable regulations.
The applicable version is the one online on the day of consultation; its date of last update appears at the top of the page. It is for the visitor to refer to it regularly.
Governing law
These Terms are governed by French law.
Failing an amicable settlement, any dispute relating to their validity, their interpretation or their performance falls within the exclusive jurisdiction of the French courts, subject to the mandatory rules of jurisdiction applicable to consumers, who retain the right to bring proceedings before the courts of their place of residence.
